PROPERTY RULES
This Property Rules (the “Rules”) sets out the terms and conditions on which we will give you access to our services and facilities and which describes our general principles. You hereby acknowledge You are a Guest on our Accommodation and that your stay at the Accommodation is governed solely by this Rules.
You confirm that you accept all of the terms and conditions contained in this Rules and our Privacy Policy and agree to us holding a copy of your photo and identification on our system for our internal use by clicking agree on this Property Rules field requirement prior to booking the Accommodation online. Entering our Accommodation means you have agreed and shall be legally bound to this Rules.
This Rules, our Privacy Policy and the Accommodation Summary form part of this Rules and a breach of them is a breach of this Rules.
We may amend this Rules at any time, in our absolute discretion, by posting the amended terms and conditions on our website or issuing an email directly to you. We operate the Accommodation and have the right to enter any room for routine inspections.
1.DEFINITIONS
The terms used in this Rules have the meanings given to them below except where a different meaning is implied by the context in which it used:

“Accommodation” means the property leased by us in terms of unit, room and assets including the movable properties installed therein and does not include external facilities in the building or surrounding areas outside belonging to third parties, in which you are staying as a Guest for a certain amount of time;

“Accommodation Fee” means the rates applicable to your Accommodation as approved by Travelio.

“Guest” means a Travelio user member who requests a booking of an Accommodation via Travelio, or the person(s) who stay at an Accommodation and is not the Owner for the associated Accommodation;

“Privacy Policy” means the document described on our website as our Privacy Policy;

“Related Entities” means our parent entity, subsidiaries, affiliates, officers, directors, agents and/or our employees;

“Travelio”, “we” or “us” means PT Horizon Internusa Persada, or any assignee or successor in title;

“You” means the person who agrees to this Rules who is to become a Guest at the Accommodation.
2.GUEST ELIGIBILITY
You may only use the Accommodation or become a Guest if You are:
  1. able to form a legally binding contract with us;
  2. over 18 years of age with proper ID (i.e. passport, ID card, driver’s license, or KITAS);
  3. able to provide a deposit of 1 (one) night Accommodation Fee or other amount determined by Travelio considering the length of Your stay, whichever is higher, that will be kept should this Rules be in breach.
You hereby warrant that when You agree to this Rules that You meet all of the criteria in points (a) – (c). We will require a photograph or copy of a suitable ID.
3.CHECK-IN PENALTIES
You have to set your check-in time on Travelio app 24 hours prior to your intended check-in time and date. Our check in time starts from 14.30 - 00.00. Should you need to check-in after 00.00, your inquiry will be subject to Travelio’s approval and will incur extra fees. In cases where you are unable to check in before midnight on the day of your arrival, you can re-schedule your check-in time to the next day and your stay will be starting from the initial date of your stay as stated on your accommodation voucher and lease agreement/PSM (Perjanjian Sewa Menyewa).
4.OVERSTAY
4.1If You stay past the reserved check-out time, You must do so with the prior written consent of Travelio and therefore agree to be charged an additional one million rupiah plus a half-day rate of the Accommodation Fee for check-out before 06.00 PM, or a full-day rate for check-out after 06.00 PM. If You can not get written consent of Travelio, You have to check-out at the latest 12.00 PM.
4.2If the breach of the provision under Clause 4.1 above, Travelio has the right to enter into the Accommodation with or without force, and take any actions as deemed necessary to recover the possession of the Accommodation. Travelio have no responsibilities for any damages and/or losses of your goods.
5.GENERAL OBLIGATIONS
5.1You are obligated to ensure that as a Guest, You will:
  1. keep your Accommodation clean and in good condition at all times, including the bedroom, bathroom, and/or kitchen area;
  2. store your personal belongings in a safe space; and
  3. comply with these Rules and any applicable rules of your Accommodation, as amended by Travelio from time to time.
5.2You are responsible for your own safety inside and around the Accommodation. You must always take notice of any rules or guidelines as applicable from time to time in your Accommodation.
5.3Travelio’s obligations and responsibility are limited to within the Accommodation area, and Travelio shall not be responsible for all Your losses, expenses, or damage caused by any events or things outside the Accommodation area.
6.MAINTENANCE
6.1If guest does not feel satisfied with the unit cleanliness, the guest should report to Travelio Customer Service within 1x24 hours of check in with proof and therefore the unit would be eligible for another re-cleaning as soon as possible.
6.2If guest finds any malfunctioning equipment in the unit, the guest should report to Travelio Customer Service within 1x24 hours of check in and therefore Travelio can proceed to fix the malfunctioning equipment as soon as possible (with consideration of working hour procedure from apartment building management).
7.RESTRICTIONS
The following acts are prohibited at all times at the Accommodation (“Prohibited Actions”):
  1. smoke in the Accommodation, including any outdoor areas of the Accommodation and anywhere within its grounds;
  2. use any naked flames of any sort including candles, incense or oil burners or any heaters or fans other than those provided by us;
  3. tamper or interfere with the computers, your internet access or your broadband connection; or
  4. bring your own furniture into the Accommodation;
  5. create disruption, noise and any means violence;
  6. use of drugs or any kind of illegal substance according to the laws of the Republic of Indonesia;
  7. prostitution and solicitation activity of any kind;
  8. bring or keep firearms, ammunitions, gun powder, gasoline or any other explosive, hazardous and/or inflammable substance and materials; and
  9. cause a fire or any other acts that may result in the Accommodation being partially or wholly damaged or vanished.
If You and/or your Visitors are found to have committed any of the Prohibited Actions above, You must contribute toward the cost of the repairs of the damage caused, and ultimately, Travelio shall be entitled to force the Guest and their Visitors to vacate the Accommodation without any refund. As such, Travelio shall terminate any contract and agreement with the Guest, and the Guest shall still be liable to complete payment for the reserved stay and forfeit any deposit.
8.VISITORS
8.1You must always accompany any visitors You have (“Visitors”) when they are in the Accommodation. Unaccompanied Visitors are considered to be a serious security risk.
8.2You must refrain from having large social gatherings of Visitors in the residence.
8.3You must not allow any Visitor or any other person who is not a guest of the Accommodation to stay overnight in the Accommodation. You must inform Travelio of any staying Visitors and provide a copy of their ID upon the beginning of their stay at the Accommodation.
8.4You must not let any person into the Accommodation if they do not have their specially made door lock password to the front door. You must keep your door lock password confidential. You shall be liable for any actions committed by or damage or loss caused by your Visitors or any person not authorized by Travelio to enter the Accommodation.
8.5You are responsible for and obliged to indemnify Travelio for any claims, losses, expenses or damage incurred or suffered by us and/or the relevant Related Entity consequent upon, arising directly or indirectly out of or relating to, or caused by Visitors or any person who is not a Guest of the Accommodation.
9.EMERGENCY
In the event of emergency or disruption in which there is an immediate danger to persons or the Accommodation or in which action is required, Travelio shall be authorized, but not obliged to, take an action as is reasonable and prudent under the circumstances.
10.TERMINATION
We may terminate your agreement with us, without notice and in our absolute discretion, retain all or part of your paid Accommodation Fees and deposit if:
  1. You breach this Rules;
  2. we are unable to verify or authenticate any information You provided to us;
  3. we believe that your actions may attract legal liability for You, or us;
  4. we suspect that You have engaged in fraudulent or any other criminal activity/organization during your stay at the Accommodation;
  5. You are deemed liable to conduct and/or has conducted yourself in a manner that will contravene the laws or act against the public order and good morals in regard to the Accommodation;
  6. You can be clearly detected as carrying an infectious disease;
  7. You violate the Prohibited Actions under Clause 5.
We shall not be held liable for any damage and loss of the furniture, fittings or any property owned or leased by us, and we are authorized to use the deposit or charge You any additional amount for the repair or replacement (at our discretion) of that item.
11.INDEMNITY AND RELEASE
You hereby indemnify and keep us and our Related Entities indemnified from and against all claims, liabilities, costs, losses, damage and expenses, including legal fees incurred or suffered by us and/or the relevant Related Entity consequent upon, arising directly or indirectly out of or relating to your actions or inactions, Prohibited Actions and negligence, in the Accommodation, including but not limited to any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) or any kind arising in connection with or as a result of use or occupancy of Accommodation, or a breach or non-observance by You of this Rules.
12.DISPUTES
Any dispute, controversy or claim arising out of or in connection with this Rules shall be settled by the courts of Indonesia.
13.NO TRANSFER
We enter into this agreement with You personally. You are not entitled to assign or transfer your rights and obligations under this Rules without our consent prior to your check-in.
14.GOVERNING LAW
This Rules shall be construed, and the rights and liabilities of the Parties shall be determined, under the laws of Republic of Indonesia.
15.ARTICLE 1266
The parties hereby agree to expressly waive the provisions of Article 1266 of the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata) to the extent that the parties agree not to seek any approval from the courts nor require the other Party to seek any approval from the courts in order to effectuate the termination of this agreement.
16.LANGUAGE
In order to comply with Law No. 24 of 2009 on National Flag, Language, Emblem and Song, this Rules has been made in English language. The Indonesian language version of this Rules has been prepared and could be found at the following link: Indonesian language version. Both the Indonesia language and English language versions are valid, however in the event of any inconsistency between the Indonesia language and English language versions, the English language version shall prevail and the Indonesia language version will be amended to conform with the provisions in the English language version of this Rules.
